General conditions
Article 1: Online Sales
Chamo BV operates the website for the sale of its products to customers worldwide. These terms and conditions govern the sale of products via the Website. The Company, hereinafter also referred to as “we” or “us,” is established in Geraardsbergen under company number BE0875.816.760. We can be reached by telephone at +32 54 240 330 and by email at bureau@chamo.be. The Buyer is any person who purchases or orders goods or services via the Website www.bojungle.eu and will hereinafter be referred to as the “Buyer” or “you.” By purchasing or ordering goods and services through the Website, you irrevocably accept these General Terms and Conditions as they exist at the time of ordering, and the application of all other terms and conditions is excluded.
Article 2: Price
The prices of our goods and services are listed on the Website in euros and include VAT and any other mandatory charges. Delivery costs are specified separately depending on the options chosen. Prices must be paid in euros, regardless of the delivery location or the Buyer’s residence. The Company is not liable if customs duties or other local charges or taxes are applied for the delivery of goods and services outside the European Union. Such duties, charges, or taxes are the Buyer’s responsibility, and you are also required to make any necessary declarations to the competent authorities of the country of delivery. The Company reserves the right to adjust its prices at any time without prior notice. Goods and services will be invoiced at the price in effect at the time the order is registered, subject to availability and administrative errors. Goods remain the property of the Company until full payment of the price. Notwithstanding this retention of title, the risk of loss or damage passes to the Buyer upon delivery of the goods. Any promotions are valid until the stated date or, in any event, no longer than one month after publication. Promotions cannot be combined. Discount vouchers cannot be exchanged for cash and will not be refunded, in whole or in part.
Article 3: Conclusion of the Sale
The sale is concluded once you have selected goods or services on the Website, confirmed the purchase after reviewing the selected goods and services and the price, the order has been received by us, and we have confirmed your order. The Company reserves the right to cancel any order from a customer with whom there is an existing dispute concerning payment of another order. The Company also reserves the right, for the safety and security of the customer, to request additional information and, in the absence of such information, to refuse to process the order.
Article 4: Availability
Our offers are valid while stocks last or subject to availability from the supplier or manufacturer. In case of unavailability after you have placed your order, we will inform you as soon as possible without being obliged to pay any compensation. We exclude all liability in this respect.
Article 5: Delivery
After acceptance of your order and payment, the goods or services will be delivered to the delivery address you provided during the ordering process. Unless otherwise agreed, delivery will take place within 30 days of ordering. After the expiry of this period, you have the right to request cancellation and a refund of your purchase. The Company bears no responsibility for late delivery, nor if delivery cannot take place due to incorrect or incomplete information provided by the Buyer at the time of ordering.
Article 6: Right of Withdrawal
If the Buyer is a consumer who purchases goods or services at a distance, he has the right to notify the Seller that he withdraws from the purchase, without penalty and without giving any reason, within 14 calendar days from the day following delivery of the goods or the conclusion of the service agreement. Refunds will be made within 30 days after receipt of your withdrawal request. The refund will be made by bank transfer to your bank account or by crediting your credit card. The consumer does not have the right to withdraw from the purchase in the cases provided by law, including when goods have been manufactured according to the consumer’s specifications or when the performance of the service agreement has begun before the end of the withdrawal period. The return of goods must be arranged by the consumer, and the related costs are entirely borne by the consumer.
Article 7: Payment
The Buyer may pay for the order by debit or credit card, via PayPal or iDeal, or by bank transfer to our account, as indicated on the Website. The price must be paid in full before delivery. In the event of late payment, default interest of 6% per year is due automatically and without prior notice, as well as a fixed compensation for the Seller’s administrative costs amounting to 10% of the outstanding sum, with a minimum of €100.
Article 8: Gift Vouchers
The Company’s electronic and paper gift vouchers can be used on the Website www.bojungle.eu. They are valid for one year from the date of issue and may be extended for an additional year against payment of an administrative fee. To use the vouchers, select the “Other payment methods” option on the “Payment” page, then choose “Gift Voucher.” Enter your code in the designated field. If the value of your order exceeds the value of your gift voucher, you must pay the difference. If the value of your order is less than the value of your gift voucher, the balance will remain as a credit. You can track your credit balance under the “My Account” section.
Article 9: Intellectual Property
All texts, comments, magazines, illustrations, and images displayed on the Website www.bojungle.eu are protected by copyright and related rights, as well as by any intellectual property rights, worldwide. Any partial or full reproduction of the Website or the Company’s catalog is strictly prohibited.
Article 10: Liability
The Company undertakes to supply only goods and services that comply with the applicable laws of the European Union and Belgium. The Company cannot be held liable in case of non-compliance with the laws of a country outside the European Union where the products are to be delivered. For goods sold to consumers, the statutory two-year warranty applies. Any lack of conformity regarding consumer sales must be reported within two months of its discovery. Any complaint regarding visible damage to delivered goods as well as damage caused during transport and delivery must be stated in writing on the accompanying documents at the time of delivery or reported by email within 24 hours after delivery. The same applies to non-conforming or incomplete deliveries. Article 11: Processing of Personal Data
By placing an online order on www.bojungle.eu, you agree that the Company will use your personal data in accordance with the applicable law of 8 December 1992 on the protection of privacy with regard to the processing of personal data. The Company uses your personal data for the performance of the contract and to keep you informed about our goods and services, including through direct marketing. You have the right to access and correct your data at any time if they are inaccurate.
Article 12: Severability
The total or partial nullity, invalidity, or unenforceability of any provision of these General Terms and Conditions, or of any clause or part thereof, shall not result in the nullity, invalidity, or unenforceability of the other provisions, clauses, or parts thereof, nor affect the validity and enforceability of the General Terms and Conditions as a whole.
Article 13: Applicable Law and Jurisdiction
These General Terms and Conditions are subject to Belgian law. In the event of a dispute, only the courts of Brussels shall have jurisdiction, without prejudice to the consumer’s right to bring the matter before the court in his own jurisdiction.
